No worries, Shelley. The IRS reports that the biggest mistake made on paper filed returns is people forgetting to sign them. As long as you made your payment and at least one of you signed it there will be no late filing penalties. They might send it back for signature but just sign and send it right back in. You'll be just fine, get some rest.

Ok, we received a call back from Petrohawk today and the lady stated that they are required to list the lease bonus payments in Box 1 because it is considered an advance royalty payment. She stated that as long as we have documentation showing that it was for a lease bonus, then we should be able to file our taxes correctly and be able to deduct the items that we need to deduct.

The corrected 1099 may take awahile. You don't have to wait since we know the numbers and they won't change.

Kathy,
Do we have to wait until we receive the corrected W2's from PHK to file our taxes, or can we go ahead and file? How long does it usually take to receive a corrected W2?
Kathy Morgan Comment by Kathy Morgan on February 11, 2009 at 10:15am
Box 2 is royalties and there are only certin things that can be deducted. They need to be reissued in box 1 as rents for the lease and signing bonus. Once the rigs start producing THEN it's royalties.
getoverit Comment by getoverit on February 11, 2009 at 8:52am
Kathy, Petrohawk has our bonus listed in box 2 (on both our 1099 and my MIL's). Is box 2 income taxed any higher or any lower than box 1 income? Do I have to request a new 1099 from them?
Kay DS1 Comment by Kay DS1 on February 11, 2009 at 7:16am
Kathy,
I was told to list the "bonus" money on "Other" under income. Why would I put it under rent in Schedule E. I am not renting it. Others in my Sections as well as the O&G attorney who oversaw our deal, agrees with the CPA. It should be under "Other". That is where he posted it.
Kathy Morgan Comment by Kathy Morgan on February 10, 2009 at 11:51pm
Good deal. Now it can be put on the return correctly as rents on the Sch E.
